| TERMS & CONDITIONS PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS SITE. USE OF THE SITE INDICATES ACCEPTANCE OF THESE TERMS AND CONDITIONS. This Web site (the “Site”) is owned and operated by Ciao Bella Tours, LLC (“CBT”). MANNEQUINS AND BAEDECKER, CIAO BELLA TOURS, and “Creative Tours for Passionate People” are trademarks and registered trademarks of Ciao Bella Tours, LLC. All rights reserved. The information, data, software, photographs, logos, graphs, video, typefaces, graphics, music sounds, images, illustrations, designs, icons and other materials (collectively “Content”) on this Site are copyrighted works of CBT. Content retrieved from this Site shall not be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, with the express permission of CBT. CBT’s use of a trademark, service mark, trade name, logo, slogan, or symbol, or other designation in connection with a product or service of another entity (including all hotels, airlines, car rental agencies, cruise tours) should not be construed as an indication of CBT’s sponsorship of, affiliation or connection with such other entity. Use of this Site does not act as an express or implied grant to you of any right or remedy under any law governing trademarks / service marks, copyrights, patents, unfair competition or trade secrets. Disclaimer and Limitation of Liability None of the Content shall be construed as an offer for the sale or provision of any services, goods, or products of CBT or any other entity. All content contained in this Site is provided for informational purposes only. CBT may modify all tour itineraries, prices, dates, hotels, departures, destinations, and availability of the foregoing at any time without notice. The Content is provided “AS IS”, without any implied or expressed warranty of any kind including, but not limited to, warranties of merchantability, fitness for a particular purpose or use, and non-infringement intellectual property. CBT does not make any warranties as to the accuracy or completeness of the Content. CBT may modify or update the Content at any time without notice, but makes to commitment to do so. Use of this Site is at your own risk. CBT shall not be liable FOR ANY MONETARY AMOUNT to you or any other user for any inaccuracy, error or omission, regardless of cause, in the Content or for any damages, including direct, indirect, special, incidental, consequential, or other damages, arising from your access to, or use of, this Site. Because some jurisdictions prohibit the exclusion or limitation of consequential or incidental damages, the above limitation may not apply to you. Traveler’s Responsibilities Payment for any and all travel packages are to be made in full, payable to Ciao Bella Tours, at least 60 days before the departure date. Any returned checks are subject to a fee of $30 for each returned check. Traveler shall be responsible for obtaining and maintaining all necessary documents BEFORE departure (i.e. valid passport, Visas (when applicable), vaccinations and/or immunizations, etc.). If the travel package includes rental properties, including, but not limited to, apartments, houses, villas, and boats, Traveler shall be responsible for all charges incurred as a result of any damage or destruction to such properties caused by Traveler. CBT is not liable for weather conditions, or any damages sustained as a result of such weather conditions, nor will CBT be liable for any and all illnesses, accidents, or deaths sustained by you or any other traveler on trip. Trip insurance is not included with, nor required for, CBT’s travel packages. However, trip insurance is highly recommended for all travelers. It is the travelers’ responsibility to purchase adequate travel insurance to cover trip interruptions, including, but not limited to, the incidents discussed above. Furthermore, CBT is not liable for any hotel and/or transportation cancellation fees due to missed or delayed flights. Finally, CBT shall not be responsible or liable for the operation of any third party service provider which may provide service to the Traveler. This includes, but is not limited to, the failure of public transportation to operate as planned or museums and other attractions to open as scheduled. CBT’s Responsibilities Notwithstanding any of the conditions set forth herein, CBT shall be responsible for tickets issued in connection with travel via land operated transportation only. No airline tickets or cruise tickets shall be issued by CBT. All travel rates quoted by CBT are tentative and not guaranteed until final booking confirmation is issued. In addition, CBT does not guarantee foreign currency rates. Tour fees published online or in the CBT brochures are based on currency exchange rates as of the date of publication by CBT. In the event of a significant currency fluctuation, CBT reserves the right to adjust its tour fees and apply a currency surcharge. While CBT attempts to get the best prices for travel, museums, and attractions at the destination for the Traveler, CBT cannot determine when third party service providers will offer discounts and other promotions which may result in a cost savings to the Traveler and coincidentally coincide with the Traveler’s booked dates. As such, CBT will not refund any monies to the Traveler should these types of promotional events occur. Cancellation All cancellation requests are the responsibility of the Traveler. Cancellation requests made prior to your departure date and must be in writing. You may submit your cancellation request by mail, facsimile, or electronic mail. However, it is your responsibility to confirm that CBT received your request. CBT shall not be liable for any lost or stolen correspondence, letters, emails or facsimiles. All cancellation requests (except for Alla Carta purchases) are subject to the following fees:
Alla Carta purchases are nonrefundable at any time. By submitting a booking request form for Alla Carta, you hereby agree to the following: 1. All Alla Carta purchases are to be paid in full at the time of purchase. Once an Alla Carta booking request form is submitted, there are no refunds. 2. CBT may use the email address on the booking request form to contact me and provide me with the details and confirmation of my reservation. It is my responsibility to ensure that the supplied email address is correct and properly operating. I agree that if I have not received any response from CBT to my submission of the booking request form within 3 days of submission, I am responsible for contacting CBT to determine status of my submission. User Comments, Feedback and Other Submissions All information, comments, feedback, suggestions and ideas disclosed, submitted or offered to CBT in connection with the use of this Site (collectively “Comments”), shall be and remain the exclusive property of CBT and may be used by CBT in any medium and for any purpose worldwide without obtaining specific consent. For example, your comments may be used in radio, television and print advertisements. Your name may be used with any Comments you submit. CBT is under no obligation to maintain your name or your Comments in confidence, to pay to you any compensation for any Comments submitted, or to respond to any of your Comments. You agree that you will be solely responsible for the content of any Comments you make Relationship with Other Parties Unless otherwise indicated, CBT is not an agent or representative of any third party and has not authorized any third party to act on its behalf. Links to Sites of Other Parties The Content contained on this Site may include links to other sites. The other sites are not under the control of CBT and CBT is not responsible for the information or content contained therein. CBT has included the links as a convenience to you. CBT does not endorse, sponsor or approve any other site, or product or service offered by any other site, for which it has provided a link. Indemnification You agree to indemnify, defend and hold us and our partners, attorneys, staff and affiliates harmless from any liability, loss, claim and expense, including reasonable attorneys’ fees, related to your violation of these Terms and Conditions or use of this Site. Miscellaneous These Terms and Conditions represent the entire agreement between you and CBT regarding your use of this Site and supersede any prior statements or representations. The performance of these Terms and Conditions shall be governed by the internal laws of the State of California, United States of America, without regard to any principles of conflicts of law. All legal proceedings arising out of or in connection with this Site shall be brought solely in the State of California. You expressly submit to the exclusive jurisdiction of said courts. Should any part of these Terms and Conditions be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect. CBT may at any time modify these Terms and Conditions and your continued use of this Site will be conditioned upon the Terms and Conditions in force at the time of your use.
